1. GENERAL PROVISIONS
These Terms and Conditions (hereinafter referred to as the “Terms”) govern the use of the website artipic.com and the Artipic software (hereinafter referred to as the “Software”). By using our website or the Software, you agree to be bound by these Terms.
Please read these Terms carefully before using the Software. If you do not agree to any of the Terms, you are not authorized to use the Software or our website.
2. LICENSE AGREEMENT
The use of the Artipic Software is governed by the End-User License Agreement (EULA), which is an integral part of these Terms. The EULA is available in several languages: English, German, French, Portugese, Swedish, Russian.
By installing, copying, or otherwise using the Software, you confirm that you have read and fully accept the terms of the EULA.
3. LICENSE ACTIVATION
3.1. The full version of the Software requires activation using a license key.
3.2. The license key is sent to the email address provided during purchase.
3.3. The license key is confidential and must not be shared with third parties. The User is solely responsible for the security of their license key.
3.4. One license key is intended for use on a single device, unless otherwise specified by the purchased license terms.
3.5. In case of loss or compromise of the license key, please contact our support team at: support@artipic.com
4. PAYMENTS
4.1. To purchase a license for the Software, the payment services specified on the website are used.
4.2. Payment processing is carried out through the Stripe payment gateway. All payment data is processed in accordance with the requirements of applicable laws, including the General Data Protection Regulation (GDPR), and Stripe’s privacy policy.
4.3. Prices for the Software are indicated in Euros and include all applicable taxes, unless otherwise stated.
4.4. We reserve the right to change prices for the Software at any time. Price changes do not affect already completed purchases.
4.5. Payment is considered accepted once the funds have been credited to our bank account.
5. CLAIMS AND REFUNDS
5.1. Refunds for purchased licenses are handled in accordance with applicable consumer protection laws, including EU Directive 2011/83/EU on consumer rights.
5.2. Refunds are possible in the following cases:
- Provision of a non-functional license key;
- Technical impossibility of using the Software on the User’s device that meets the system requirements.
5.3. To request a refund, please send a written request to: support@artipic.com with the following information:
- Full name of the User;
- Email address used for purchase;
- License key (if received);
- Description of the reason for the refund.
5.4. Requests are reviewed within 10 business days. In case of a positive decision, the refund is processed within 30 calendar days from the decision date.
5.5. Refunds are processed using the same payment method used for the purchase.
6. LIMITATION OF LIABILITY
6.1. THE SOFTWARE IS PROVIDED “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES.
6.2. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT IT WILL MEET YOUR EXPECTATIONS.
6.3. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DAMAGES, INCLUDING LOSS OF DATA, PROFITS, OR BUSINESS REPUTATION, ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE.
7. INTELLECTUAL PROPERTY
7.1. The Artipic Software is the intellectual property of Modern Graphics Solutions LLC and is protected by copyright laws and international treaties.
7.2. All rights to the Software, trademarks, logos, and other elements related to Artipic belong to Modern Graphic Solutions LLC.
7.3. These Terms do not transfer any intellectual property rights to the User, except for the right to use the Software in accordance with the EULA.
8. GOVERNING LAW AND DISPUTE RESOLUTION
8.1. For Users located within the European Union, these Terms are governed by and construed in accordance with the laws of Sweden. For Users outside the EU, these Terms are governed by the laws of Sweden.
8.2. All disputes arising out of or in connection with these Terms shall be submitted to the competent courts of Sweden, unless otherwise required by mandatory provisions of applicable law.
8.3. Prior to instituting legal proceedings, the Parties shall make reasonable efforts to resolve the dispute through negotiation. A formal complaint shall be submitted in writing and shall be reviewed within thirty (30) calendar days of receipt.
9. CHANGES TO THE TERMS
9.1. We reserve the right to amend these Terms at any time.
9.2. Changes become effective upon publication on the website.
9.3. Continued use of the Software or the website after changes are made constitutes your acceptance of the updated Terms.
